VPS Service Terms

Last updated 15 October 2026 · S Ward Host Ltd. (trading as BinaryFall)

These VPS Service Terms (“VPS Terms”) apply to virtual private server services (“VPS”) supplied by S Ward Host Ltd., a company registered in England & Wales, trading as BinaryFall. They add to our Terms of Service. If the two conflict for a VPS, these VPS Terms apply. In particular, the restriction on general-purpose workloads in the Terms of Service applies to game-server plans and not to a VPS.

1. What you are buying

  • A VPS is a virtual machine running on our physical infrastructure. It is not an entire physical server, and the underlying hardware is shared with other customers’ virtual machines.
  • Your plan states its memory, vCPU count and disk size. We provide what the plan states. We do not promise dedicated physical cores, a fixed network speed or a data-transfer allowance unless your order says so.
  • The operating system is one of the images listed on our VPS pricing page. We do not supply Windows. Some images (for example CloudLinux) need a licence that you must hold yourself; the order page says which.
  • We set up each new VPS by hand after your payment is received, and we email you as soon as it is ready. We do not promise a set-up time. If we cannot deliver the VPS you ordered, we refund you in full (see section 6).

2. Self-managed service

  • You get administrative (root) access to your own VPS only. You do not get access to our hosting platform or to other customers’ machines.
  • You are responsible for everything inside your VPS: the operating system, updates and security patches, firewall rules, software, users, passwords and keys, and your data.
  • You are responsible for holding the licences and rights for any software you install.
  • We run the hosting platform. We do not manage your applications unless we agree that in writing and you pay for it.
  • Our control panel can open a terminal or connection to your VPS when you ask it to. We do not otherwise look at the contents of your VPS, except where needed to investigate a security or abuse problem, or where the law requires it.

3. Network access

Your control panel shows how to reach your VPS, including its SSH address. Any IP addresses, IPv6 allocation, network speed or transfer limit that apply to your plan are stated in your order. Extra IP addresses that you buy are assigned by our team by hand after your VPS is delivered, so they can appear shortly after the VPS itself. We do not offer “unlimited” network use. Some ports or traffic may be restricted to protect the network, and we will say so if that affects your plan.

4. Backups and data loss

  • The control panel includes backup tools. The backup allowance that comes with your plan is confirmed in your order.
  • You should keep your own copies of important data. A backup on our platform does not replace that.
  • Reinstalling a VPS erases everything on its disk. The panel asks you to confirm first. We cannot recover data after a reinstall unless you made a backup beforehand.
  • When a VPS is deleted or cancelled, its data is deleted. Take a copy before you cancel.

5. Availability, maintenance and support

  • We provide the service with reasonable care and skill. We do not guarantee uninterrupted service, and no uptime guarantee or service credit applies unless it is stated in your order.
  • We may carry out maintenance and will give notice where we reasonably can. Urgent security or stability work may need to happen without notice.
  • Support is by support ticket or support@binaryfall.com. Support covers the hosting platform and your VPS being reachable. It does not cover configuring or fixing software inside your VPS.

6. Payment, renewal and suspension

  • The price and billing term are shown before you pay. Prices are shown excluding VAT; VAT is added at checkout where it applies, based on your location.
  • You pay when you order. Your paid period does not start until your VPS is delivered to you. Once we deliver it, your first full billing term runs from that day, and your next payment is due at the end of it.
  • If we cannot deliver the VPS you ordered, we refund the payment in full.
  • A VPS renews at the end of each term, charged automatically to the payment method you used, until you cancel.
  • If a payment fails, we may suspend the VPS straight away and we email you. A suspended VPS is not deleted automatically. We delete suspended or cancelled VPSs by hand after a retention period, and we try to email you first.
  • To cancel, contact support@binaryfall.com or open a support ticket from your account address. Cancelling stops future renewals. See the VPS Cancellation & Refund Policy for what happens to the period you have paid for.

7. Acceptable use

Your use of a VPS must follow the VPS Use Agreement. We may suspend or remove a VPS that breaks it.

8. Liability

The limits on liability in our Terms of Service apply to VPS services. Nothing in these VPS Terms limits any right you have by law that cannot be limited, including for death or personal injury caused by negligence, fraud, or services that are not provided with reasonable care and skill.

9. Changes and contact

We may update these VPS Terms. If a change is material for an active VPS, we tell you before it applies. Questions: support@binaryfall.com.
