VPS Use Agreement
Last updated 15 October 2026 · S Ward Host Ltd. (trading as BinaryFall)
This VPS Use Agreement applies to every BinaryFall VPS, alongside the VPS Service Terms. A VPS is a general-purpose machine, so lawful general-purpose use is allowed. The rules below protect other customers, the network and third parties.
1. What is not allowed
- Anything illegal, or hosting or sharing illegal material.
- Distributing malware, running phishing or fraud sites, or hosting command-and-control infrastructure.
- Attacking other systems: denial-of-service attacks, attempts to break into or take over systems you do not own, and scanning other networks for weaknesses. Security-testing images such as Kali Linux may only be used against systems you own or have written permission to test.
- Sending unsolicited bulk email or spam, or running an open mail relay.
- Running an open proxy or open resolver that others can abuse. Lawful VPN and proxy use for yourself and your own users is allowed.
- Spoofing IP addresses or hijacking network routes.
- Using resources in a way that harms other customers or the platform. Sustained, heavy use of CPU, disk or network, including cryptocurrency mining, is not allowed where it degrades other customers or our platform.
- Trying to access the hosting platform, other customers’ machines, or the control panel’s underlying systems.
- Reselling or sharing access in a way that hides who is responsible for the VPS.
2. Your responsibility
You are responsible for what happens on your VPS, including activity caused by software you install or by someone who gains access because of a weak password, a stolen key or unpatched software. Keep your VPS updated and secured.
3. Abuse reports and what we do
- Report abuse from a BinaryFall VPS to abuse@binaryfall.com. Include the IP address, the time with timezone, and any logs.
- When we receive a report or detect a problem, we normally tell you what we found and ask you to fix it within a stated time.
- Urgent cases. If a VPS is causing immediate harm, such as an ongoing attack or a security threat, we may restrict its network access or suspend it straight away, and tell you as soon as we can.
- We act in proportion to the problem. Repeated or serious breaches can lead to termination.
- If you think we have acted in error, reply to our message or contact support@binaryfall.com and we will review it.
- We keep evidence of the problem for as long as we need it to deal with it, and we may share it with the authorities where the law requires or allows.
4. Refunds on termination
If we terminate a VPS for breaking this agreement, we do not refund the unused part of the term. Your statutory rights are not affected. See the VPS Cancellation & Refund Policy.
