Use Agreement

This Use Agreement (the “Agreement”) sets out the rules for using BinaryFall game-server hosting and the control panel. It supplements, and forms part of, our Terms of Service, Privacy Policy, and Cookie Policy. By deploying a server, purchasing a plan, or starting a free trial, you confirm that you have read and accept this Agreement.

1. What you may use the service for

• Running the game server(s) you purchased or trialled, and the tools, mods, and plugins that support them.
• Storing world data, configuration, and backups related to those servers.
• Inviting other people to your server, provided you remain responsible for their conduct.

2. Prohibited use

You must not use the service to host, store, transmit, or facilitate any of the following. This list is not exhaustive and mirrors section 3 (Acceptable use) of our Terms.

• Anything unlawful, or that infringes another party’s intellectual-property or privacy rights.
• Child sexual abuse material (CSAM) or content sexualising minors — we terminate immediately and report to the authorities.
• Malware, phishing, botnets, or command-and-control infrastructure.
• Denial-of-service attacks, port scanning, spam, or attacks on third parties originating from our network.
• Cryptocurrency mining, general-purpose VPS / proxy / VPN use on a game-server plan, or workloads unrelated to your game server. A VPS plan is covered by the VPS Use Agreement instead.
• Attempts to bypass resource limits, disrupt other customers, or probe our infrastructure.

Public file-sharing rules

You may share lawful game-server files through the panel's public download links only when you have the right to distribute them. Review every file in a folder before publishing it. Do not expose passwords, SSH keys, API tokens, player personal data, stolen information, malware, or content that breaches the rules above. Links must not be used for spam, phishing, unrestricted public file hosting, or a CDN.

Do not bypass expiry, download-start, size, storage, or bandwidth limits, or use automated downloads to exhaust resources. We may disable abusive links and restrict or suspend services under this Agreement. Removing or shuffling a link invalidates the old URL, but does not erase downloaded copies. Snapshots are fixed copies, not a backup service. Report an abusive link privately to abuse@binaryfall.com.

3. Fair use of resources

Server resources (RAM, vCPU, disk) are provisioned to your plan. There is no artificial cap on player slots or normal game bandwidth, subject to fair-use limits. We may throttle, suspend, or ask you to upgrade a server that consistently exceeds fair use or degrades the experience of other customers on the node.

4. Free trials

• Free trials are limited to one per customer and run for the stated trial period, after which the server is suspended and its data deleted 7 days later unless you upgrade to a paid plan.
• Trials are provided “as is” with no uptime guarantee. Back up anything you want to keep.
• Abuse of the trial system (multiple accounts, prohibited use above) results in termination without notice.

5. Backups & data

You are responsible for keeping your own backups of anything important. While we provide backup features, we are not liable for data loss. Suspended and cancelled servers are deleted after the 7-day grace period described in section 5 of our Terms.

6. Suspension & termination

We may suspend or terminate a server for non-payment, expiry of a trial, cancellation, or breach of this Agreement or our Terms. Where practical we give notice; for serious breaches (e.g. illegal content, attacks on third parties) we act immediately. Cancelling a paid service and any refund you may be entitled to are covered by our Refund Policy.

7. Changes

We may update this Agreement from time to time. Continued use of the service after an update constitutes acceptance. Questions? Email support@binaryfall.com.
