Use Agreement

This Use Agreement (the “Agreement”) sets out the rules for using BinaryFall game-server hosting and the control panel. It supplements, and forms part of, our Terms of Service and Privacy Policy. By deploying a server, purchasing a plan, or starting a free trial, you confirm that you have read and accept this Agreement.

1. What you may use the service for

• Running the game server(s) you purchased or trialled, and the tools, mods, and plugins that support them.
• Storing world data, configuration, and backups related to those servers.
• Inviting other people to your server, provided you remain responsible for their conduct.

2. Prohibited use

You must not use the service to host, store, transmit, or facilitate any of the following. This list is not exhaustive and mirrors the Acceptable Use section of our Terms.

• Anything unlawful, or that infringes another party’s intellectual-property or privacy rights.
• Child sexual abuse material (CSAM) or content sexualising minors — we terminate immediately and report to the authorities.
• Malware, phishing, botnets, or command-and-control infrastructure.
• Denial-of-service attacks, port scanning, spam, or attacks on third parties originating from our network.
• Cryptocurrency mining, general-purpose VPS / proxy / VPN use, or workloads unrelated to your game server.
• Attempts to bypass resource limits, disrupt other customers, or probe our infrastructure.

3. Fair use of resources

Server resources (RAM, vCPU, disk) are provisioned to your plan. “Unlimited” slots and bandwidth are subject to fair-use limits. We may throttle, suspend, or ask you to upgrade a server that consistently exceeds fair use or degrades the experience of other customers on the node.

4. Free trials

• Trials are limited to one per account and run for the stated trial period, after which the server is suspended and later removed unless you upgrade to a paid plan.
• Trials are provided “as is” with no uptime guarantee. Back up anything you want to keep.
• Abuse of the trial system (multiple accounts, prohibited use above) results in termination without notice.

5. Backups & data

You are responsible for keeping your own backups of anything important. While we provide backup features, we are not liable for data loss. Suspended and cancelled servers are deleted after their grace period.

6. Suspension & termination

We may suspend or terminate a server for non-payment, expiry of a trial, cancellation, or breach of this Agreement or our Terms. Where practical we give notice; for serious breaches (e.g. illegal content, attacks on third parties) we act immediately.

7. Changes

We may update this Agreement from time to time. Continued use of the service after an update constitutes acceptance. Questions? Email support@binaryfall.com.
