Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the BinaryFall website and game-server hosting services (the “Services”), operated by S Ward Host Ltd., a company registered in England & Wales, trading as BinaryFall (“BinaryFall”, “we”, “us”). By creating an account or purchasing a service, you agree to these Terms.
1. Eligibility & accounts
- You must be at least 18 years old, or 13+ with the consent and supervision of a parent or legal guardian who accepts these Terms on your behalf.
- You must provide accurate account and billing information and keep it up to date.
- You are responsible for all activity under your account and for keeping your credentials secure. Notify us immediately at support@binaryfall.com of any unauthorised access.
- One person or legal entity per account. You may not share, sell, or transfer your account without our written consent.
2. The Services
We provide managed game-server hosting running on isolated containers, with a control panel, DDoS protection, and the features described on the relevant product page. Server resources (RAM, vCPU, disk) are provisioned to the plan you purchase. “Unlimited” slots and bandwidth are subject to the fair-use limits in our Add-ons & Limits policy, which forms part of these Terms.
3. Acceptable use
You agree not to use the Services to host, store, transmit, or facilitate any of the following. This list is not exhaustive.
- Anything unlawful under the laws of England & Wales or your jurisdiction, or that infringes another party’s intellectual-property or privacy rights.
- Child sexual abuse material (CSAM) or content that sexualises minors. We terminate the service and report it to the authorities.
- Malware, phishing, botnets, command-and-control infrastructure, or tools intended to gain unauthorised access to systems.
- Denial-of-service attacks, port scanning, spam, or any activity originating from our network that targets third parties.
- Cryptocurrency mining, general-purpose VPS/proxy/VPN use, or workloads unrelated to running the game server you purchased.
- Attempts to bypass resource limits, disrupt other customers, or probe our infrastructure.
We may suspend or terminate any service that breaches this section, with or without notice depending on severity. Our Use Agreement expands on these rules and forms part of these Terms.
4. Your content & backups
You retain ownership of the files, worlds, and data you upload (“Your Content”). You grant us the limited licence necessary to host, transmit, and back up Your Content solely to provide the Services — nothing broader. We do not use Your Content to train AI models, and we do not license it to anyone else. You are responsible for ensuring you have the rights to Your Content, including for any mods, plugins, or maps you install. Automated backups are provided on eligible configurations on a best-effort basis. Keep an independent copy of anything you cannot afford to lose.
5. Payment, billing & renewals
- Prices are set in Euros (EUR) as the base currency and may be displayed in your local currency for convenience. Actual charges are processed in EUR. Applicable taxes are added where required.
- Services are billed in advance for the billing cycle you select (monthly, quarterly, semi-annually, or yearly) and renew automatically unless cancelled before the renewal date.
- You can cancel at any time from your dashboard, in a few clicks, without contacting us.
- Payments are processed by Stripe; we never receive or store your full card details.
- If a payment fails, we may retry and will suspend the service after a grace period. Prolonged non-payment may lead to termination and deletion of data.
- We may change prices with reasonable notice; changes apply from your next renewal, and you may cancel before then if you do not accept them.
6. Referral credits
- BinaryFall may offer a referral program under which you earn BinaryFall Credits when someone you refer completes their first paid order.
- Credits are an in-website discount balance only. They are not money, currency, a deposit, or a stored monetary value of any kind, have no cash value, and cannot be withdrawn, redeemed for cash, transferred to another person or account, sold, or exchanged for any real-world currency or cryptocurrency.
- Credits may only be applied as a discount against BinaryFall services at checkout, up to the full value of an order.
- We may adjust, expire, or revoke credits, or suspend the referral program, at any time, including where we suspect fraud, abuse, self-referral, or manipulation of the program.
- Credits are never refunded as money. Where an order is refunded, credits spent on it return to your credit balance — see our Refund Policy.
7. Connecting an AI assistant
The control panel can optionally be connected to an AI assistant of your choosing so you can manage your server in plain English. If you use this:
- You choose the assistant and authorise the access level on a consent screen. You are responsible for that choice and for anything done under it.
- Actions an assistant takes are treated as your actions. Restarting, editing files, or deleting backups affects your server exactly as if you had done it yourself, so grant the narrowest access that does the job.
- AI output is probabilistic and can be wrong. Check anything consequential before relying on it, and keep backups.
- The assistant provider’s own terms and privacy policy apply to data it receives. We do not control that provider. See our Privacy Policy for what is shared.
- You can revoke access at any time from the panel.
8. Third-party services & software
The Services let you install third-party software — game servers, mods, plugins, and maps — which is licensed by its own authors under its own terms, not ours. You are responsible for complying with those terms and with the rules of the game publisher whose server you run. We provide installation tooling as a convenience and do not endorse, warrant, or support third-party software. Payments run through Stripe and sign-in may run through Google, each under their own terms.
9. Our intellectual property
The BinaryFall name, logo, website, control panel customisations, documentation, and the arrangement and presentation of the Services are owned by S Ward Host Ltd. or our licensors and are protected by intellectual property law. These Terms grant you a limited, non-exclusive, non-transferable right to use the Services while your account is in good standing — nothing more. You may not copy, resell, reverse engineer, or create derivative works from our platform, or use our branding without written permission. Underlying open-source components remain governed by their own licences.
10. Copyright complaints
If you believe content hosted on our network infringes your copyright, email support@binaryfall.com with the subject line “Copyright complaint” and include: the work concerned, where the infringing material is (server address or URL), your contact details, a statement that you believe in good faith the use is unauthorised, and a statement that the information is accurate and you are the rights holder or authorised to act for them. We investigate promptly and may remove content or suspend a service. Repeat infringers are terminated.
11. Cancellation, suspension & termination
You may cancel a service at any time from your dashboard; it remains active until the end of the paid period. We may suspend or terminate the Services if you breach these Terms, fail to pay, or where required by law. On termination, your service and associated data may be permanently deleted after a short retention window. Refunds, where applicable, are governed by our Refund Policy.
12. Service availability
We aim for high availability but do not guarantee the Services will be uninterrupted or error-free. We may perform maintenance, occasionally with short notice for urgent security work. Planned regions and features described as “coming soon” are indicative and not a commitment to a date.
13. Warranties & limitation of liability
The Services are provided “as is” and “as available” to the fullest extent permitted by law. Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot lawfully be excluded — including a consumer’s statutory rights under the UK Consumer Rights Act 2015 and equivalent EEA law. Subject to that, our total aggregate liability arising from the Services is limited to the amounts you paid us for the affected service in the three (3) months preceding the claim. We are not liable for loss of data, profits, or goodwill, or for indirect or consequential loss.
Some jurisdictions do not allow certain exclusions or limitations of liability, so parts of this section may not apply to you. Where that is the case, our liability is limited to the minimum the law allows.
14. Indemnity
If you use the Services as a business, you agree to indemnify BinaryFall against claims, losses, and costs arising from Your Content or your breach of these Terms or the Acceptable Use section. This does not apply to consumers.
15. Changes to these Terms
We may update these Terms from time to time. Material changes will be notified by email or on the website before they take effect. Continued use after changes take effect constitutes acceptance. If you do not accept a change, you may cancel before it applies.
16. Governing law & disputes
These Terms are governed by the laws of England & Wales, and disputes are subject to the exclusive jurisdiction of its courts. If you are a consumer resident in the EEA, this does not deprive you of the protection of the mandatory consumer law of your country of residence, and you may bring proceedings in your local courts. Consumers in the EEA may also use the European Commission’s online dispute resolution platform. Nothing here affects your statutory rights.
